Eligibility Requirements
Thanks to the landmark LEGION Act (signed into law on July 30, 2019), the eligibility criteria were updated. Today, membership is open to any person who has served federal active duty in the United States Armed Forces and was honorably discharged, or is still serving on active duty.
Qualifying Active Duty Eras
- Current Era: December 7, 1941 to the present. Because eligibility dates remain open-ended, all current active-duty military personnel are eligible to join immediately.
- World War I Era: April 6, 1917 to November 11, 1918.
*Note: U.S. Merchant Marine eligibility is specifically restricted to service from December 7, 1941 to December 31, 1946 (WWII).
Core Rule: You must have served at least one day of active military duty during one of these qualifying periods and have been honorably discharged or currently serve honorably. (Veterans who served only on inactive duty for training—such as traditional National Guard or Reserve weekend drills without federal active duty orders—do not meet baseline congressional charter requirements).
Proof of Eligibility
When applying as a new member, you will need to provide a copy of your discharge paperwork (such as your DD214). If you cannot find your papers, copies can be requested online via the National Archives website. Official active-duty or mobilization orders can also serve as temporary proof.
